By accessing or using our repair services (the “Services”), you (“Customer,” “you,” “your”) agree to be bound by the following Terms of Service (the “Terms”.

Please read carefully. If you do not agree to all Terms, you may not use our Services. Any new features, tools, or policies added to the Services will also be subject to these Terms. We may update or modify these Terms at any time by posting the most current version on our website. Your continued use of the Services after changes are posted constitutes acceptance of those changes.

SECTION 1 – SERVICES

We provide repair, diagnostic, and related services for consumer electronics. While we exercise reasonable care and skill, we do not guarantee that every device can or will be repaired, nor that repairs will restore full functionality or last indefinitely.

SECTION 2 – PAYMENT TERMS

All fees are due immediately upon completion of repair unless otherwise agreed in writing. Failure to pay constitutes breach of this Agreement. We reserve the right to retain your device until payment is made. Devices unclaimed or unpaid 30 days after repair completion will be considered abandoned. Abandoned devices may be sold, recycled, or otherwise disposed of at our sole discretion in order to recover costs. You waive all rights and claims to abandoned devices.

SECTION 3 – SHIPPING & HANDLING

If you ship your device to us, you do so at your own risk. We are not responsible for loss, theft, or damage during transit. Customers are strongly encouraged to use tracked and insured shipping.

SECTION 4 – CUSTOMER RESPONSIBILITIES

By submitting a device for repair, you represent and warrant that:

- You are the legal owner of the device or have full authority to request service.
- You have backed up all data prior to service. We are not responsible for loss, corruption, or disclosure of data.
- You authorize us to perform repairs, including but not limited to disassembly, part replacement, and testing.

SECTION 5 – DATA & PRIVACY

We do not intentionally access or copy your personal data except as necessary to perform repairs. However, repairs may result in data loss, corruption, or disclosure. You are solely responsible for protecting and backing up your data.

SECTION 6 – LIMITATION OF LIABILITY

The Services are provided “as is” and “as available.” To the fullest extent permitted by law: We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, or consequential damages, including but not limited to data loss, diminished performance, lost profits, or further device damage. Our maximum liability for any claim shall not exceed the amount you paid for the repair.

SECTION 7 – INDEMNIFICATION

You agree to indemnify and hold harmless FinSec, its officers, employees, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services, breach of these Terms, or violation of applicable laws.

SECTION 8 – DISPUTE RESOLUTION & ARBITRATION

You and FinSec agree that any dispute or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA). You waive the right to participate in a class action or jury trial. If arbitration is deemed unenforceable, disputes shall be resolved in the state or federal courts of Cook County, Illinois.

SECTION 9 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

SECTION 10 – TERMINATION

We reserve the right to refuse or terminate service at any time if you fail to comply with these Terms. Termination does not relieve you of payment obligations incurred prior to termination.

SECTION 11 – ENTIRE AGREEMENT

These Terms, together with any written service quotes or agreements, constitute the entire agreement between you and FinSec and supersede all prior understandings, whether oral or written.

SECTION 12 – AGREEMENT TO TERMS

By handing over, shipping, or otherwise requesting repair services from FinSec, you acknowledge that you have read, understood, and agreed to these Terms of Service.
